AFL Anti-trust exemption?

Just re-reading Michael MacCambridge's "America's Game", and I got to wondering. When the NFL signed their t.v. contract in 1961, it was struck down by the courts, and they had to get congress to pass the Sports Broadcasting Act of 1961 to give them an anti-trust exemption. But the deal that the AFL reached with ABC in June, 1960 would appear to have been the same -- money divided equally between the clubs -- as the NFL's deal. Was there no consideration given to whether or not the AFL was in violation of anti-trust laws by entering into their contract with ABC? Or was just a situation where nobody cared enough to challenge it in court?
